Terms of Service & User Agreement

1. Acceptance of Terms

By uploading content to this platform, you agree to be bound by these Terms of Service and User Agreement. If you do not agree to these terms, you must not upload any content.

2. Content Ownership and Rights

You represent and warrant that:

• You own or have the legal right to upload and share the content you submit
• You have obtained all necessary permissions, licenses, and consents from any individuals appearing in your content
• Your content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party
• You have the right to grant the licenses described in these terms

3. License Grant

By uploading content, you give the artist and the platform operator a non-exclusive, worldwide, royalty-free license, for as long as your content is stored on the platform, to:

• Store, host, and display your content on the platform, including in public event galleries
• Use, reproduce, distribute, and publicly perform your content in connection with the event and artist's promotional activities
• Create derivative works (such as compilations or highlights) for promotional purposes
• Share your content on social media and other marketing channels

You retain ownership of your content and may continue to use it for your own purposes.

You can ask us to remove your upload at any time through our contact page. We then remove it from the platform. We cannot recall copies the artist already shared outside the platform before your request.

4. Prohibited Content

You agree not to upload content that:

• Is illegal, harmful, threatening, abusive, or violates any laws
• Contains hate speech, harassment, or discrimination
• Infringes on intellectual property rights of others
• Contains personal information of others without consent
• Is spam, malware, or contains viruses
• Violates any applicable privacy laws or regulations

5. File Safety and Validation

All uploaded files undergo automated validation to ensure they match their declared file type. Our platform uses industry-standard magic byte verification to prevent file type spoofing and verify file integrity.

What We Do:

• Verify file signatures match declared MIME types
• Enforce strict whitelist of allowed video and image formats
• Validate files before allowing uploads to complete
• Stream videos through secure platform infrastructure (not direct downloads)

Your Responsibility:

You are responsible for ensuring your uploaded files are free from malware, viruses, or other malicious code. By uploading, you warrant that your files do not contain harmful software and will not damage or compromise the platform or other users' systems.

Note: We do not perform antivirus scanning on uploaded files. Our validation focuses on file type verification and format compliance. Video files are streamed through browser-based players, which provides inherent protection against executable malware. This approach is consistent with industry practices for user-generated content platforms.

6. Privacy and Data

Your uploaded content may be stored, processed, and shared as described in these terms. We respect your privacy and handle your data in accordance with our Privacy Policy. By uploading, you consent to the collection, storage, and use of your content as described herein.

7. Content Moderation

The platform operator may review, remove or refuse content that breaks these terms or the law. Where we can reach the person who uploaded it, we will tell them why it was removed.

8. Indemnification

You agree to indemnify and hold harmless the platform operator, the artist, and their respective affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your uploaded content or your violation of these terms.

9. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The platform will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The platform is free of viruses or other harmful components
• The results of using the platform will meet your requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE PLATFORM OPERATOR, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE PLATFORM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (B) $100 USD.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Subscription and Refund Policy

If you are a paying subscriber:

• Billing: Subscriptions are billed on a recurring basis (monthly or annually) and will automatically renew unless cancelled before the renewal date
• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period
• Refunds: All subscription fees are non-refundable, except where required by applicable law. If you cancel your subscription, you will not receive a refund for the current billing period, but you will retain access to paid features until the end of that period
• Price Changes: We will tell you at least 30 days before we change the price of your subscription. The new price only applies to your subscription if you agree to it. If you do not agree, your subscription continues at the old price until we end it at the end of a billing period, with at least 30 days' notice. Nothing changes for features you already paid for
• Failed Payments: If a payment fails, you keep your paid plan while the payment is retried. If it still fails, your account moves to the Free plan when the subscription ends, or after 30 days, whichever comes first. Nothing is deleted because of this
• When a Paid Plan Ends: If your account is over the Free plan limits, your content is kept and new uploads pause. We will not remove content because of a plan change without emailing you at least 30 days in advance. You can download your videos at any time
• Free Trial: If we offer a free trial, you will be charged the subscription fee at the end of the trial period unless you cancel before the trial ends

12. Termination

We may suspend or terminate an account right away, without notice, only for serious breaches of these terms, such as:

• Uploading illegal content
• Fraud
• Abuse of the platform or of other users

For other violations of these terms, we will contact you first and give you a chance to fix the problem before we take action.

We do not delete accounts automatically for inactivity. A Free account that is empty (no events, no videos and no email subscribers) and has had no activity for 24 months may be closed. We will email you at least 30 days before that happens. Accounts with content are not deleted for inactivity.

We may also end a Free account, or stop offering the service, with at least 30 days' notice by email. We can end a paid subscription with the same notice, effective at the end of a billing period. In both cases you can download your videos before the account closes.

Artists can delete their account at any time in their account settings. Fans can ask for their uploads to be removed through our contact page. Termination does not relieve anyone of obligations incurred before termination.

13. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

For disputes arising from or in connection with these Terms, the exclusive place of jurisdiction shall be Berlin, Germany.

If you are a consumer within the European Union, you also have the right to bring proceedings before the courts of your country of residence.

14. Dispute Resolution

Informal Resolution: Before filing a claim, you agree to contact us and attempt to resolve the dispute informally by sending a written notice to aftershow.site@gmail.com. We will attempt to resolve the dispute informally by contacting you via email.

EU Online Dispute Resolution: The European Commission provides an online dispute resolution platform, which you can access at https://ec.europa.eu/consumers/odr.

Consumer Rights: If you are a consumer in the EU, nothing in these Terms affects your statutory rights under applicable consumer protection laws.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the platform, constitute the entire agreement between you and us concerning the platform and supersede all prior or contemporaneous agreements, understandings, and communications, whether written or oral.

17. Changes to Terms

These terms may be updated from time to time. When we do, we post the new version on this page and update the "Last updated" date. We will tell you about material changes in advance, by email or with a notice in the app.
